    SPECIALIZED REAL ESTATE LEGAL SERVICES

    Comprehensive practice areas.

    01

    Acquisitions, Conveyancing &
    Contract Review

Before you sign, we secure your investment by conducting deep due diligence on developer permits (Trakheesi) and escrow accounts. We manage the drafting and review of your Sale and Purchase Agreement (SPA) and navigate all mandatory Dubai Land Department (DLD) documentation — including Form A (Seller/Broker agreement), Form B (Buyer/Broker agreement), and the legally binding Form F (Purchase Contract).

    02

    Off-Plan Delays & Project
    Cancellations

We protect buyers caught in stalled developments by navigating DLD and RERA procedures to enforce developer obligations. If your project is delayed beyond the statutory 12-month grace period established under Executive Council Resolution No. 6 of 2010, we execute formal contract cancellations to recover your escrow funds and claim compensation for breaches of contract.

    03

    Mis-Sold Properties & Size
    Discrepancies

Did the developer deliver less than promised? We aggressively litigate cases of fraudulent misrepresentation and strictly enforce RERA's regulations, which require developer compensation for any property size shortfall exceeding the 5% tolerance limit. We also hold developers accountable for structural defects discovered up to 10 years post-handover under UAE Civil Code provisions.

    04

    Real Estate Arbitration & Litigation

When negotiations fail, we deploy the most experienced property litigation team in Dubai. Depending on your jurisdiction clause, we represent you aggressively in DIAC arbitration, the English-language DIFC Courts (Small Claims Tribunal or First Instance), and the mainland Dubai Property Court to resolve high-stakes breaches of contract and secure direct enforcement orders.

    05

    Landlord & Tenant Disputes (RDC)

We draft ironclad commercial and residential leasing agreements strictly compliant with DLD and Ejari requirements. Operating extensively within the Rental Dispute Center (RDC), we resolve complex disputes regarding unlawful eviction notices, rent cap violations, and unreturned security deposits, ensuring you avoid costly administrative mistakes during statutory notice periods.

    06

    Property Inheritance for Expats

Secure your Dubai real estate for your family. Without a registered will, your property may default to statutory intestacy rules or Sharia principles. We help non-Muslim expats draft and register wills under Federal Decree-Law No. 41 of 2022. Whether utilizing an English common-law DIFC Will or a bilingual ADJD Will, we guarantee full testamentary freedom over who inherits your UAE assets.

    JURISDICTIONAL COMPARISON MATRIX

DIFC Courts vs. Dubai Courts, a
    transparent breakdown.

Built for institutional investors, family-office managers, and general counsel evaluating forum strategy across the two legal frameworks Aqaar Legal operates within.

JURISDICTIONAL FEATURE ENTITY 01 / DIFC DIFC Courts via AWS Legal Consultancy ENTITY 02 / ONSHORE Dubai Courts via Suhad Al Juboori Advocates
Foundational Legal System Governed by English Common Law Governed by UAE Civil Law
Language of Proceedings Exclusively English Exclusively Arabic, translation heavily required
Jurisdictional Trigger Mechanism Requires a specific 'opt-in' jurisdiction clause drafted into the SPA or lease Default, automatic jurisdiction for all mainland Dubai properties without clauses
Small Claims Infrastructure Small Claims Tribunal (SCT) for rapid resolution of claims under AED 500k Rental Dispute Center (RDC) specifically for landlord/tenant matters
Judgment Enforcement Directly enforceable in onshore Dubai via the Judicial Authority Direct enforcement executed via local execution courts

Choosing the correct forum at the contract drafting stage is the single most consequential strategic decision in any UAE property transaction. We routinely advise on jurisdiction clauses before disputes arise.

    COMMON QUESTIONS

    Got questions?
    We have answers.

Direct, plain-language responses to the concerns we hear most often from expat property owners and overseas investors. If your situation isn't covered below, reach out to discuss it with a senior associate.

Yes. Since the introduction of Federal Decree-Law No. 41 of 2022, non-Muslim property owners are not automatically bound by Sharia distribution principles — provided they have a registered will. We assist clients in drafting and registering specialized wills through the DIFC Wills Service or the Abu Dhabi Judicial Department (ADJD), granting full testamentary freedom over who inherits your Dubai assets.

You have strong legal options. Once the developer's standard 12-month grace period expires, we can file a formal complaint with the DLD or RERA to pursue contract cancellation, a full refund of your escrow funds, or financial compensation for damages. Acting quickly is critical — delayed action can prejudice the strength of your claim.

Sale and Purchase Agreements (SPAs) are typically drafted heavily in favour of the developer. We review your SPA to flag unfair payment schedules, hidden cancellation penalties, ambiguous handover clauses, and to verify that the developer's escrow accounts and Trakheesi permits are properly registered with the relevant authorities — protecting you before money changes hands.

In most matters, no. We accept Powers of Attorney executed and notarised in your country of residence (with appropriate legalisation or apostille), allowing us to represent you fully in DLD/RERA proceedings, the Rental Dispute Center, DIFC Courts, and onshore Dubai Courts without your physical presence.

Real estate consultations with Aqaar Legal start from AED 750 and are strictly confidential. A senior associate will review your situation, identify the applicable jurisdiction, outline your strategic options, and provide a transparent fixed-fee or hourly engagement quote before any further work commences.

It depends on the contract, the property location, and any jurisdiction clause in your SPA or lease. DIFC Courts apply English common law in English; onshore Dubai Courts apply UAE civil law in Arabic. We assess your documents at the consultation stage and recommend the forum that maximises your leverage and recovery prospects.
